BIOCOM MEDIA TERMS AND CONDITIONS OF USE
The digital image(s), video(s) or presentation(s), (hereinafter referred to as collectively, the “Media”) available for use and/or for sale on this website are copyrighted and owned by Biocom International AG. (here in after referred to as “Biocom”). Biocom retains all rights, license, copyright, title and ownership of the Media. There is no warranty, express or implied, with the use or purchase of any Media on this website. Biocom will not be liable for any claims, or incidental, consequential or other damages arising out of the license granted or your use of the Media. Unauthorized use is prohibited.
I. Personal Use License for Digital Downloads
When you access, use, purchase and download Media from this website, Biocom as the owner of the copyrighted Media, grants you as the User and/or Buyer a non-exclusive, perpetual, personal-use license to download and copy the accompanying Media subject to the following restrictions:
(a) This license is for personal use only. Personal use means non-commercial use of the Media for display on personal websites and computers, or making image prints or video copies for personal use. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The Media may not be used in advertising. The Media may not be resold, relicensed, or sub-licensed.
(b) Buyer may not resell, relicense, redistribute without express written permission from Forever Living. Buyer may not use or incorporate the Media as a derivative work, and reselling or
redistributing such derivative work is prohibited.
(c) Buyer is only authorized to use the Media in conjunction with the performance of the Biocom Business Owner’s duties and obligations under the Agreement and the corresponding Company Policies and procedures. The Personal-Use license granted shall be effective only as long as the Business Owner is in good standing and in full compliance with Biocom Company Policies and procedures. The Media has great value to Biocom and is supplied to each Owner for each Owners’s use in an expressly authorized manner only.
(d) Media may not be used in a pornographic, obscene, illegal, immoral, libelous or defamatory manner. Media may not be incorporated into Forever Living’s trademarks, logos, or service marks. Media may not be made available for download.
(e) Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with Biocom.
II. General Terms of Sale:
(a) All proceeds from the sale of Media, above and beyond the operational costs to maintain the website, will be donated to Biocom Giving.
(b) All prices are listed in GBP british pounds. Biocom reserves the right to change the payment methods it accepts at any time without notice. If we are unable to process your credit card payment and you do not provide an alternative form of payment, we may terminate your order.
(c) Biocom may revise or discontinue Media at any time without prior notice, and Media may become unavailable even after an order is placed. All prices are subject to change without notice.
(d) Return Policy. Biocom unconditionally guarantees your satisfaction. If you are unsatisfied with any Media you purchase from the website, we will gladly accept the return of any Media you have ordered from us for any reason within thirty (30) days of receipt and reprint the Media or refund the purchase price. Upon completion of the return procedure and receipt of the returned Media, we will resend you the Media or issue you a full refund of the purchase price paid for such Media, whichever you prefer. However, we will generally not refund your original shipping cost unless your order is defective in some manner.
(e) Disclaimer of Warranties. THE FOREGOING RIGHT TO RETURN ANY ORDER WITHIN THIRTY (30) DAYS IS YOUR SOLE AND EXCLUSIVE REMEDY, AND BIOCOM’S SOLE AND EXCLUSIVE LIABILITY, WITH RESPECT TO THE PURCHASE OF ANY MEDIA FROM THE SITE, AND FOREVER LIVING EXPRESSLY DISCLAIMS AND EXCLUDES ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PURCHASE OF ANY MEDIA.
